ILG has extensive experience in IP litigation and enforcement, including the traditional federal and state court litigation and platform specific enforcement and dispute resolutions systems (i.e., Amazon brand registry and neutral patent evaluation). ILG has also represented clients in Trademark Trial and Appeals Board (TTAB) proceedings, representing clients in opposition and cancellation proceedings.
Recent TTAB successes include:
-Successfully represented an independent online retailer owned by U.S. Army veterans against a potential opposition challenge by a major clothing retailer.
-Successfully represented a virtual medicine client’s trademark against a major U.S. private university who is known to file aggressive trademark oppositions against smaller entities.
Recent Trademark litigation successes include:
Madsen v. Fisherman’s Life, LLC: ILG is lead counsel in a trademark infringement case, representing Matts Madsen, owner of the famous fishing lifestyle online channel Fisherman’s Life, with more than 1 million subscribers on YouTube, against Fisherman’s Life LLC, a junior user who operates a confusingly similar domain www.fishermanslife.com.
Copyright Litigation Successes include:
-Successfully represented clients in obtaining zero-dollar settlements for non-meritorious copyright infringement claims involving the use of online stock photographs.
-Successfully represented clients in fighting against non-meritorious copyright strikes in YouTube resulting in significant advertising revenues.
BAD FAITH INSURANCE LITIGATION
ILG is among the firms in Northern California who are participating to help businesses achieve Business Interruption coverage during the COVID-19 Pandemic of 2020, and was one of the few firms who were able to secure settlement for their business clients in the Farmers JCCP-5125 Business Covid Litigation.
wage and hour claims
-Successfully represented Bay Area business owners, including restaurants, general contractors, and medical practices in actual and potential wage and hour claims.
-Successfully represented employees in filing claims against their employers for unpaid wages, overtime, and unpaid breaks and meal breaks against their employers.
wrongful termination
ILG has represented employees, co-founders, and business partners in wrongful termination claims against their employers.
Representative cases include:
Finn v. County of Los Angeles, et al.: ILG is co-counsel for the whistleblower former employee of Los Angeles County Department of Children and Family Services (DCFS). Mr. Finn revealed allegedly dangerous practices that put thousands of Los Angeles County children and families in risk of harm that ultimately led to the death of two young children.
Bisch v. Yolo Food Bank, et al.: ILG is co-counsel for a high-profile former executive director to Yolo Food Bank, the largest nonprofit food bank organization in North California. Mr. Bisch attempted to shed light to governmental non-compliance to the state food recovery mandate, and was wrongfully terminated from his executive director position as a result of governmental pressure on the non-profit board.
